Terms of Use

These terms are between you and Applied Ego Software LLC (appliedego.com) (“Pacepin”, “we”), reached at hello@pacepin.app. You agree to them when you tap Agree in the app. If you do not agree, do not use Pacepin. Our Privacy Policy explains what we collect and why.

You must be 18 or older and live in the United States. You need an account. Give accurate details when you make it and keep them current, keep your password to yourself, and tell us at hello@pacepin.app if you think someone else has used your account. You are responsible for activity on your account. Two-step verification is available in the app, and we recommend it.

Don't use Pacepin while driving. Set it up before you set off, and leave answering its notifications, entering pay or checking the map until you are safely parked. Obey traffic laws and road conditions over anything the app shows. You are responsible for how and when you use your phone in a vehicle, and to the extent the law allows, we are not liable for injury, damage or loss caused by using the app unsafely.

Pacepin is an app for keeping your own records of gig work: shifts, miles, earnings, expenses, vehicles and receipt photos. It organises those records and shows estimates worked out from them. It is not affiliated with, endorsed by or connected to any delivery or rideshare platform.

Mileage deductions, tax set-aside amounts and every other tax figure in Pacepin are estimates based on your records and published rates, with the assumptions stated beside them. They are not tax advice, not a tax return, and not a guarantee of any deduction or outcome. Pacepin does not decide what is deductible, and does not guarantee that its records meet any tax authority's requirements. Check anything you rely on with a qualified tax professional.

Pacepin uses your phone's location to measure your miles, as the Privacy Policy describes. By starting a shift you allow it to record your location until the shift ends or you take a break. If you turn on automatic mileage, you allow that phone to watch for you driving off, and to record detected drives, until you turn it off or sign out. You can stop either at any time in the app or in your phone's Settings.

What you record belongs to you. You let us store, copy and process it only to provide Pacepin to you. You are responsible for its accuracy, including confirming which drives were work and adding anything your records need, such as the business purpose of a trip. GPS can be wrong or incomplete: signal gaps are estimated and marked, and the phone's settings, battery saving, and closing the app can stop recording. Review and correct your records. You can export them at any time, on any plan, and delete them as the Privacy Policy describes.

Pacepin Pro is an optional subscription that adds automatic mileage (Pacepin noticing a drive and asking whether it was work) and Insights. Automatic mileage can be used without Pro for 14 days from the first time your account turns it on; after that it pauses unless you subscribe, and every drive it recorded stays in your records. Pro is sold through the App Store at the price shown there before you buy. If a free trial is offered, its length is shown before you start it, and the subscription price is charged when it ends unless you cancel at least 24 hours before the trial ends. The subscription renews automatically each month or year until you cancel it in your Apple Account settings, at least 24 hours before the end of the current period. Deleting your Pacepin account does not cancel it. If the price changes, Apple tells you before the new price applies, and you can cancel before it does. Refunds are handled by Apple under its policies. If you cancel, you keep Pro until the end of the period you paid for. Afterwards automatic mileage pauses, and you keep every record and export on the free plan. App Store purchases are also subject to Apple's Licensed Application End User License Agreement and Apple's terms.

Don't misuse the service: no attempts to access other people's data or accounts, to interfere with or overload the service, to copy or reverse engineer it except as the law allows, or to use it for anything unlawful.

We give you a personal, non-transferable, revocable licence to use the Pacepin app on devices you own or control. Pacepin, its design and its content (other than your records) belong to us. If you send us ideas or feedback, we may use them without owing you anything for them.

Pacepin works alongside services it does not control: maps, your phone's location and notification systems, the App Store, and the delivery and rideshare apps you work for. They are governed by their own terms, and we are not responsible for them, for what they show, or for your dealings with them. Pacepin is not affiliated with any delivery or rideshare platform, and pay you enter is your own record, not theirs.

These terms are between you and us, not Apple. Apple is not responsible for Pacepin or its content, and has no obligation to provide maintenance or support for it. If Pacepin fails to meet a warranty that applies, you may tell Apple, and Apple will refund the purchase price, if any; beyond that, and to the extent the law allows, Apple has no warranty obligation for it. We, not Apple, are responsible for dealing with any claims about Pacepin, including product liability claims, claims that it fails to meet a legal or regulatory requirement, consumer protection claims, and claims that it infringes someone's intellectual property. You confirm you are not located in a country subject to a U.S. government embargo and are not on a U.S. government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

You can stop using Pacepin and delete your account in the app at any time. We may suspend or end an account that breaks these terms or to comply with the law, and will tell you when we can. Sections that by their nature should survive, such as the disclaimers and limits below, continue after your account ends.

We work to keep Pacepin available and your records safe, and we may change, add or remove features as the product develops; if we remove something you pay for, we will tell you first. The service is provided “as is” and “as available”. To the extent the law allows, we disclaim warranties not stated in these terms, including that Pacepin will be uninterrupted, error-free, or that its figures will be accurate or accepted by any tax authority.

To the extent the law allows, Pacepin is not liable for indirect, incidental or consequential losses, or for decisions made on the basis of estimates shown in the app. [Overall liability cap — to be set with an attorney.] Nothing in these terms limits liability that cannot be limited by law.

If these terms change in a way that matters, the effective date above moves and the app asks you to read and agree to the new version before you continue using it.

We send notices about your account by email or in the app, and you agree to receive them that way. You may not transfer these terms to anyone else; we may transfer them as part of a sale or reorganisation of the business. Not enforcing a term is not giving it up. Nothing here makes us partners or makes either of us the other's agent. If part of these terms cannot be enforced, the rest still applies. These terms and the Privacy Policy are the whole agreement about Pacepin between you and us.
